California Man Shoots Pregnant Girlfriend’s 3-Year-Old Son After Accusing Her of Infidelity

A very horrific incident happened in a residential neighborhood in Santa Clara, California, in the early hours of February 20. A man was accused of shooting his pregnant girlfriend’s 3-year-old son on an allegation of suspected infidelity. The domestic argument quickly turned into a nightmare when the man took a gun and shot the innocent child at close range.

Sergio Colin-Gomez, aged 24, was taken into custody after the incident where he shot the child in the head. The shooting took place around 2:30 a.m. at Riley Square Apartments, located just off Lawrence Expressway north of El Camino Real.

The Santa Clara District Attorney’s Office released a statement detailing the incident on Thursday. Prosecutors revealed that Ivan and his pregnant mother were watching TV at their apartment when Gomez arrived home. Once the little boy drifted off to sleep, the suspect began accusing the mother of infidelity. 

According to the police department’s statement of facts, the defendant relentlessly tried to coerce the woman into admitting to cheating. He was repeatedly demanding a “Yes or No” answer.

The statement reported that Colin-Gomez kept telling her, “Don’t be stupid.” Fearing for her safety, the mother locked the door to her son’s room. The release stated that Colin-Gomez forcefully entered the room, briefly left, and returned with a handgun.

Afterward, Colin-Gomez aimed the gun within a foot of the child’s head. But in fear, the mother attempted to grab the weapon. However, Colin-Gomez fired the fatal shot before fleeing from the apartment. “The suspect fired the fatal shot then fled the apartment,” the statement said.

Around 2:00 a.m., Ivan’s mother dialed 911 to report that her boyfriend shot her baby. Upon arrival, responding officers discovered Colin-Gomez walking along the sidewalk. Police reported that he initially resisted arrest but was eventually subdued and taken into custody.

Additionally, prosecutors mentioned that alongside the murder charge, Colin-Gomez faces an additional charge of assaulting a child under eight years old, resulting in death.

“We are sickened and heartbroken at the senseless murder of Ivan,” District Attorney Jeff Rosen said in a statement. “Nothing we achieve in court, no jury or judge, can make up for the lost life of this innocent child. We will sadly but steadfastly do our job to make sure this person will never harm another.”

Colin-Gomez, who is not Ivan’s father, was arraigned on Thursday on charges of murder and assault. If found guilty, he could be sentenced to life in prison. Gomez’s previous criminal record in the county mainly involves traffic violations, except for a misdemeanor in 2019 for disturbing the peace. 

However, court records indicate that in December 2018, an 18-year-old Gomez was arrested for refusing to leave his ex-girlfriend’s home in Sunnyvale. He was making threats to burn it down. Gomez allegedly resisted the responding police officers who were attempting to detain him. 

He pleaded no contest to the disturbance charge and was ordered by the court to undergo anger management training and complete 40 hours of community service. Unfortunately, this incident is a sad reminder of how much harm guns can cause when they’re not used responsibly. Hopefully, justice will be served for little Ivan.
