The Biden administration has issued a very serious Cease-and-Desist order against the state of Texas. The Department of Homeland Security (DHS) sent a letter to the state demanding that they allow the U.S. Border Patrol to access the U.S.-Mexico border.
According to several reports, Texas National Guard soldiers, along with their equipment and physical barriers, are restricting Border Patrol from accessing about 2.5 miles of the border.
Therefore, DHS General Counsel Jonathan Meyer wrote a letter to Texas Attorney General Ken Paxton citing these unconstitutional restrictions. “The recent actions by the State of Texas have impeded operations of the Border Patrol,” Meyer wrote.
“Those actions conflict with the authority and duties of Border Patrol under federal law and are preempted under the Supremacy Clause of the Constitution.” In his letter, he demanded an immediate cease-and-desist of any actions obstructing Border Patrol.

“Texas’s actions also improperly seek to regulate the federal government. I am writing to demand that Texas immediately cease-and-desist any actions taken by the State that block Border Patrol’s full access to the U.S.-Mexico border in and around the Shelby Park area,” he continued.
Meyer also cited an incident that led to the death of a mother and two children. According to him, they could have prevented these untimely deaths if the Texas National Guard had allowed Border Patrol to save them. Sadly, they couldn’t get to them in time, and the three of them died in the Rio Grande.
The DHS announced the deaths of these victims and expressed their outrage at the Texas National Guard for not letting help get to them. Sources say that the guards did not allow border patrol to help the drowning family because of strict directives by the Governor, Greg Abbott.

However, the Texas Military Department disputed the DHS’s statement. They claim that they were aware of the distress report but could not locate the migrants in the river body. Meyer noted this incident and insisted that Abbott’s rules are causing dangers to life and safety.
“Texas’s failure to provide access to the border persists even in instances of imminent danger to life and safety. Texas has demonstrated that even in the most exigent circumstances, it will not allow Border Patrol access to the border to conduct law enforcement and emergency response activities,” he wrote.
A spokesperson from the White House also expressed their disappointment at Abbott’s actions. “A woman and two children drowned near Eagle Pass, and Texas officials blocked U.S. Border Patrol from attempting to provide emergency assistance,” they said.

“While we continue to gather facts about the circumstances of these tragic deaths, one thing is clear: Governor Abbott’s political stunts are cruel, inhumane, and dangerous. U.S. Border Patrol must have access to the border to enforce our laws.”
Since the migration crisis began, Abbott has taken many bold steps to reduce the impact on Texas. He also bussed thousands of migrants to various shelter cities across the country under his “Operation Lone Star.”
