Federal Judge Stops Biden’s Anti-Discrimination Healthcare Rule Based Around Gender Identity

A federal judge has halted the new healthcare policy of the Biden administration that would permit the US healthcare service providers to refuse treatment based on the patient’s gender identity.

This rule was sold as an anti-discrimination healthcare policy that would have enabled federal funding to reach trans individuals pursuing hormones, surgery, and other gender-affirming services.

The Biden Rule 

The Biden administration overturned a Trump administration regulation in April 2024. By announcing a new rule that would safeguard LGBT Americans seeking medical treatment.

Health and Human Services Secretary Xavier Becerra stated that at the time “today’s rule is a giant step forward for this country. As it is towards a more equitable and inclusive health care system. Americans across the country now have a clear way to act on their rights against discrimination when they visit the doctor. Also, talk with their health plan, or engage with health programs run by HHS.”

Ruling of the Judge 

The decision is hailed by the proponents of the rights of the transgender. Who for a long time considered the act of the denial of care to transgenders on the grounds of gender as a violation of their human rights.

The effect of this judgment of the judge on the Transgenders has yet to be seen.

However, this may mean that the Biden administration may have to appeal the decision and maintain its healthcare policy. Or it may have to come up with another policy that complies with federal law.

A Win for Supporters 

This judgment can be seen as a win for the supporters of the rights of trans people. Also, a loss for the pro-LGBTQ+ president of the United States, Joe Biden.
