The effort to prosecute Donald Trump has left District Attorney Fani Willis with some challenges. The attorney has been embroiled in a legal battle with Trump over possible election interference. However, recent findings have threatened to derail the prosecution.
Fani Willis, 52 years old, has been the district attorney for Fulton County since she was elected in 2021. Willis made national limelight after she filed an election malpractice lawsuit against Trump. According to the case, Trump and 18 other individuals are under trial for attempting to overturn his 2020 election loss in Georgia.
Trump had lost the state by around 12,000 votes. Trump maintains his not-guilty plea, claiming he didn’t do anything wrong. However, Willis has suffered some obstacles threatening to disqualify her as the case’s leading prosecutor.
Willis had come under intense criticism after news of her relationship with Nathan Wade was made public. Wade is the special investigator Willis had employed to fact-find for the case. According to the allegations, Willis and Wade have used taxpayer funds for their financial benefits. Trump’s attorneys have claimed a conflict of interest as a result of the affair.

While they have both admitted to having a relationship, which has now ended, they claimed there was no conflict of interest. After the allegations broke, a hearing was held in which it was decided that Willis would maintain her position on the prosecution.
However, Wade was asked to resign from his position, as to prevent future conflict of interest. The hearing was presided over by Judge Scott McAfee. Despite this Willis continues to face criticism and pressure from the public and Trump supporters.
So it came as no shock when, in May 2024, the Georgia Court of Appeals decided to retry the disqualification case. On Monday, June 3, 2024, the disqualification appeal arguments were scheduled for October 4, 2024. With the new date set, there is a doubt that the election interference case will not continue before the election. The 2024 presidential election is set for November 5, 2024, a month after the set date.

In another setback, one of Trump’s Co-defendants, Harrison Floyd, has been able to bring a litigation against Willis. Floyd is a former leader of the organization, Black Voices for Trump. Floyd had announced X, which informed the public of his success in securing an appeal. However, he did not go into detail about what the appeal would take.
Floyd is under trial after three charges were filed against him. He has been accused of participating in a harassment scheme targeting an election worker in Atlanta. Floyd has now pleaded not guilty to the charges. In May 2024, an appeal was filed to ensure the discontinuation of the trial, but it was denied.
Floyd had asked to recount all 528,777 votes cast in Fulton County to find evidence to show that the election interference cost Trump the state. According to Scott Lucas, all of Flody’s antics were just for him to avoid being held responsible.
Lucas also claimed that all the actions carried out by Trump’s associates was to ensure the case doesn’t go to trial before the election. He also claimed that he believes that despite their appeal, Willis will remain on the case. Scoot Lucas is a professor in international politics at University College Dublin.

McAfee dismissed six allegations against the former president and his supporters in March 2024. The defendants did not get “adequate information to prepare their defenses sensibly,” according to McAfee, who said in his conclusion that the “lack of specificity about a key legal aspect” was “fatal” to the six charges.
Willis petitioned an appeals court to resurrect these allegations in May 2024, and lawyers commented on the likelihood of their reinstatement.
