A Similar Case of Father Killing Son

On August 17, 2021, Brandon Lee Cervera and his ex-wife Miranda Casarez allegedly starved their son Benjamin to death. On Tuesday, September 24, 2024, the trial of Cervera began three years after Benjamin was declared dead at San Antonio Hospital.

In May 2022, a press release was made by the district attorney’s office announcing Cervera’s indictment on charges of causing serious injury to a child. Subsequently, on Wednesday, September 25, 2024, Officer Omar Perez testified before jurors about his visit to Cervera’s residence in 2021.

Perez said, “Benjamin had visible injuries. He had bruises on his eyes and torso, and he was skinny … able to see his bones.” However, Cervera denied the allegations, attributing Benjamin’s bruises to his behavioral problems.

According to defense attorney Jodi Soyars’ opening statement, she claimed that Benjamin was small and that doctors had no health concerns before his death. Prosecutors used photos of Benjamin’s body during the medical examiner’s testimony to show his malnourished state.

This showed the jury the level of starvation that Benjamin was subjected to. Additionally, the medical examiner confirmed Perez’s claims of bruises on Benjamin’s body found during the postmortem examination.

James Lukefahr, who attended to Benjamin in the San Antonio hospital before his death, stated in his testimony that the young man was underweight for his age. Lukefahr added that he concurred with the medical examiner’s conclusion that malnutrition was the cause of Benjamin’s death.

During the medical examiner’s testimony, prosecutors presented the jurors with photographs of the boy’s body to highlight his malnourishment and weight. Additionally, the medical examiner corroborated Perez’s allegations regarding the boy’s injuries.

The victim’s mother left for work, leaving him in charge of their son when she returned. Following an initial hearing on September 19, 2024, Edmonds is being held without bond at the RSW Regional Jail in northern Warren County. A second hearing was originally scheduled for October 17, 2024, but postponed until 9:45 a.m. on December 19, 2024.
