Miley Cyrus Faces Copyright Lawsuit Over Hit Song “Flowers”

According to a newly filed lawsuit, Miley Cyrus is under litigation after being accused of plagiarizing Bruno Mars. On Monday, September 16, 2024, Tempo Music Investments filed a lawsuit in Los Angeles alleging that Cyrus copied elements of “When I Was Your Man” in “Flowers.” 

Cyrus’ career-defining song, “Flowers,” was released on January 13, 2024, which was also her ex-husband Liam Hemsworth’s birthday. The lawsuit states, “Any fan of Bruno Mars’ ‘When I Was Your Man’ knows that Miley Cyrus’ ‘Flowers’ did not achieve all of that success on its own.

The complaint added, “‘Flowers’ duplicates numerous melodic, harmonic, and lyrical elements of “When I Was Your Man.”

Miley Cyrus Copyright Lawsuit Allegations

In the lawsuit, Tempo Music states that “Flowers” includes various musical elements such as melodic pitch designs, bass lines, chorus bars, theatrical music elements, lyric elements, and specific chord progressions.

For context, Tempo Music shares the copyright for “When I Was Your Man,” released in 2013 from Mars’ album “Unorthodox Jukebox.” The company gained the rights when they purchased the catalog of Philip Lawrence, one of the song’s co-writers. However, despite being released ten years apart, the songs contain similar lyrics.

In Mars’ song “When I Was Your Man,” he sings, “I should’ve bought you flowers and held your hand; I shoulda gave you all my hours when I had the chance; Take you to every party, ’cause all you wanted to do was dance; now my baby’s dancin’, but she’s dancin’ with another man.”

In Cyrus’ “Flowers,” she sings, “I can buy myself flowers, write my name in the sand, talk to myself for hours, say things you don’t understand, take myself dancing, and I can hold my own hand. Yeah, I can love me better than you can.” In 2024, Cyrus’ “Flower” won the Grammy for Best Pop Solo Performance, a fact the lawsuit included.
