Lawmakers Move to Violate Second Amendment Rights By Banning Militias

“A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed,” reads the Second Amendment to the United States Constitution. Despite these very clear provisions, the extreme left has attempted to ban state militias in the country. 

Massachusetts’ Senator Edward Markey, a Democrat, is championing this move with his introduction of the “Preventing Private Paramilitary Activity Act.” This bill doesn’t seek to outlaw guns or ammunition as is the democrat’s typical fashion.

However, it’s equally brazen in its attempt to go against the supreme laws of the land. As expected, Markey claims that his bill is motivated by the “insurrection” of January 6, 2021. 

“Three years ago, white supremacists affiliated with paramilitary organizations stormed the U.S. capital, shattering windows, walls, and the families of five U.S. Capitol police officers,” he said.

“Private paramilitary actors, such as the Proud Boys and Oath Keepers, pose a serious threat to democracy and the rule of law, and we must create new prohibitions on their unauthorized activities that interfere with the exercise of people’s constitutional rights. The forces of bigotry, hatred, and violent extremism must be stopped for the sake of our democracy,” he added.

But here’s the twist — all the states in the USA have laid down laws limiting the activities of private paramilitary. Even though there is no federal legislation restricting their activities, the states have already covered that. So, the purpose of the legislation has left many confused. 

Even the motivation behind the bill is questionable. The so-called “January insurrection” didn’t significantly threaten the government. In fact, the Capitol attack wasn’t violent enough to be called an insurrection. Insurrections only happen when there is a plan to take over an established government.

Regardless, Jamie Raskin, Maryland Democratic rep., has drummed her support for the bill as its co-sponsor.

“Our legislation makes the obvious but essential clarification that these domestic extremists’ paramilitary operations are in no way protected by our Constitution. I’m grateful to Senator Markey for his partnership on this critical effort to protect the rule of law, deter insurrection, and defend our democracy,” he said. 

Other Democrats and their supporters have, unsurprisingly, backed the idea. One of them, Deana El-Mallawany, has this to say, “As the events of January 6, 2021, laid bare, the rise of private paramilitary groups poses a real threat to democracy and the rule of law. In recent years, we have seen such groups interfere with the exercise of constitutionally protected rights, attempt to carry out unsanctioned law enforcement activities, and target vulnerable populations.”

If Markey and Raskin’s bill is passed, defaulters will be at risk of jail time. Newsnation reports that private individuals will also be able to file civil claims for damages.

The other provisions of the bill are also needless because again, state and federal laws have already covered them. For example, the bill bans militias from disguising themselves as police officers and preventing private citizens from fully enjoying their rights. Numerous laws have already criminalized these activities.
